What do both parties agree to?
You: You have authority to execute this contract on behalf of yourself, your company or your organization. If you’re hiring us for a consulting and support package: You plan to access the marketing systems and documentation regularly for training yourself and your team on how to maximize results
from your marketing. You will contact support via our help desk with any questions you have, giving us the opportunity to provide the highest level of value possible. We earnestly wish you to get the best results possible, so ongoing review of the content we provide and communication to address any questions you have is essential.
Regarding development work: You’ll give us the assets and information we tell you we need to complete the project, before the clock starts ticking on our end. You’ll review deliverables and provide feedback promptly, enabling us to complete any necessary revisions for you in a timely fashion. “Feedback” means a complete list of any changes you want to have made to the design. Deadlines work both ways, so you agree that if we’ve not heard from you within 10 business days, deliverables will be considered accepted.
Us: We have the experience and expertise necessary to help you get the best results possible from your marketing. This comes from many years of testing and refining our marketing strategy and the process of documenting everything we’ve learned. It also comes from the many relationships we’ve formed over the years and our ability to introduce you to the best vendors and freelancers who can provide any services you may need to help you get the results you seek even faster. If you hire us for a consulting and support package, we are bound to provide you access to all our documented systems, access to our referral network and ongoing support to answer any of your questions. We are also bound to provide prompt response to any questions you send us through our help desk. Lastly, we’re bound to maintain the confidentiality of everything you send us.
Design
All our designs are mobile-responsive. This means your website (if you’re hiring us to create one) will work great on all mobile devices. We do not “wireframe” or waste time mocking up every template as a static visual. Our focus is on efficiently delivering a website you can see and interact with.
You’ll have the opportunity to review the deliverables and provide feedback. If we need content from you, we’ll provide an online folder where it can be easily uploaded. If at any stage, you change your mind about what you want to be delivered, decide you want to add new items that weren’t previously agreed upon or take the project in a new direction, that’s no problem. We’ll simply provide you a quote for the additional work. We understand that things change sometimes, and we always want to remain flexible to help you achieve your goals.
Content
Unless stated specifically in writing, we’re not responsible for inputting text or images into your content management system or creating every page on your website. We provide professional copywriting and editing services, so if you’d like us to create new content or input content for you, we can provide separate pricing for that.
Graphics and photographs
If you have specific graphics you’d like used for your project, you agree to supply them in an editable, vector digital format. You agree to supply photographs in a high resolution digital format. If you choose to buy stock photographs, we can suggest stock libraries. If you’d like us to provide
photographs for you, we can provide separate pricing for that.
Browser testing
Browser testing no longer means attempting to make a website look the same in browsers of different capabilities or on devices with different size screens. It does mean ensuring that a person’s experience of a design should be appropriate to the capabilities of a browser or device. We test our work in current versions of major desktop browsers, including those made by Apple (Safari), Google (Chrome), Microsoft (Edge), Mozilla Firefox and Opera.
We’ll also test to ensure that people who use the current version of Internet Explorer for Windows get an appropriate experience. We also test in latest iOS and Android devices. We won’t test in old, outdated browsers unless we agree separately in writing. If you need an enhanced design for an older or obscure browser, we can provide separate pricing for that.
Search engine optimization (SEO)
Every website we build is created using best practices for search engine visibility. We offer SEO campaigns (sold separately) to continually improve search engine rankings over time. We, like any above board SEO vendor, cannot guarantee specific results.
Changes and revisions
We don’t want to limit your ability to change your mind. The pricing in this contract is based on the amount of time that we estimate we’ll need to accomplish everything you’ve told us you want to achieve, but we’re happy to be flexible. If you want to change your mind or add anything new, that won’t be a problem. We’ll simply provide a separate proposal for the additional work. If and when new features or project requirements are entered into the equation, they will be handled exclusively under separate cover, and all the terms we’ve previously agreed upon will stay in effect.
Sandbox and completion
If you’ve received deliverables and have not responded to any of our followup attempts for a period of 10 business days (2 weeks), your project will be sandboxed. “Sandboxing” means we’re not actively working on your project. We understand things get very busy sometimes, and you may have started a project with us but cannot continue to correspond for a period of time. Things happen. When you have time, please respond to us. We’ll get you back on our calendar after hearing from you, according to our current availability.
Upon contacting us after a period of inactivity, please understand there may be a waiting list. We’re actively growing our company, and we ask that you respect our schedule just as we respect yours. If your project remains sandboxed for a period of 6 months, we’ll mark your project as complete. We assume that any development work that has been delivered to you and has not garnered a response from you for a period in excess of 6 months is deemed acceptable. We will reopen any development project at any time, according to our current availability. However, if a project has been inactive for 6 months or more, new development work will need to be ordered.
Single point of contact
Upon beginning work together, you will supply us with a Single Point of Contact. This is the administrative person that we will correspond with regarding your account. This person needs to have the ability and availability to make decisions regarding both creative and billing concerns. This Single Point of Contact can be the owner, CEO, office manager, creative director or any representative of your operation.
In exchange, we will also provide a Single Point of Contact with our company. A dedicated account manager is assigned to you for the duration of your development project. This greatly expedites and enhances the creative and marketing work to be done together.
Displaying our work
We love to show off our work, so we reserve the right to display all aspects of our creative work, including sketches, work-in-progress designs and the completed project on our portfolio and in articles on websites, in magazines and in books.
Cancellation of service
You may cancel any active service agreement at any time, for any reason. Simply notify us via the support page (https://bulletproofmarketer.com/client-support). Upon notifying us via our support page (https://bulletproofmarketer.com/client-support), cancellation will be effective within 30 days.
If an agreement is part of a term commitment (3 months, 12 months, 3 years, etc), those terms will remain in effect. Upon cancellation, you will continue to receive access to your website until the closing of your account. This gives you up to 30 days to procure a backup of your files. If you need assistance backing up your files, please contact us through the support page (https://bulletproofmarketer.com/client-support). We can migrate your site for a fee. You retain full rights to use your design, content and all media files that have been hosted on your website. Your backed up files can be used to install your website on a new server, so you will not lose anything.
We do not retain backups once an agreement has expired and is not renewed. We also reserve the right to cancel any active service agreement for any reason. In the event we discontinue a service agreement, the work of moving the website and securing service with an alternate vendor is squarely on our shoulders. We think that’s only fair. In such an event, service agreement-related fees paid to us the same month of cancellation will be refunded.
Additionally, if there is a website being serviced by us at the time we cancel an account, we will migrate the website to an alternate hosting provider of our choice. Migration expenses and first month of hosting will be covered by us.
PLEASE NOTE: If there is a balance due upon cancellation, your account must still be paid current. Website will be available for delivery after any outstanding balance has been paid.
Billing
Consulting and support billing is for services rendered and is due in full upon receipt. Packages are available month-to-month, annually, triennially (3 years), and quinquennially (5 years). Financing of these fees may be available for qualified clients. Fees paid for services rendered are not refundable unless otherwise stated in writing.
Nonpayment and late fees
If full payment is not received, service and support can be suspended. Service will recommence after your account is paid current. If payment is more than 30 days late on an account, we may remove the account from our system. A re-installation fee will apply upon reactivation of service. In the event of nonpayment or late payment, a 3% late fee may be assessed to the amount due each month, until payment in full is rendered.
Uptime
Our servers have consistently maintained a 99.9% uptime for as long as we’ve been in business, but this does not represent a guarantee. There are periods of time when maintenance needs to be performed. During these periods of time, various assets may be briefly unavailable. Downtime rarely exceeds 15 minutes, and notification of any downtime-related events is sent via email.

Support is accessible 24/7 through our help desk (https://bulletproofmarketer.com/client-support). As a client, you are also assigned a dedicated account manager. Your account manager is accessible through our help desk as well. Support correspondence is conducted via email. A call can be scheduled with your account manager through our help desk at or near the end of each calendar month, to review your site and marketing performance and discuss steps to optimize performance. It is our sincere recommendation you schedule and attend this monthly performance review with your account manager. Phone consultation must be scheduled in advance and is subject to availability.

As an active client, you will of course be notified via email of any changes to these Terms of Service, so you are always aware of any changes.
Legal stuff
We’ll carry out our work in accordance with good industry practice and at the standard expected from a suitably qualified person with relevant experience. That said, we can’t guarantee our work will be error-free and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised us of them. Your liability to us will also be limited to the amount of fees payable under this contract and you won’t be liable to us or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if we’ve advised you of them.
If we were to for any reason end up in court, you will pay all legal fees necessary to compensate our legal team in the event we win in court. After two decades in business, we’ve not yet had to exercise this even once (knock on wood), but our legal team strongly advises we have this in the contract. Finally, if any provision of this contract shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.
Phew.
But where’s all the horrible fine print?
Just like a parking ticket, neither of us can transfer this contract to anyone else without the other’s permission. We both agree that we’ll adhere to all relevant laws and regulations in relation to our activities under this contract and not cause the other to breach any relevant laws or regulations. This contract stays in place and need not be renewed. Although the language is simple, the intentions are serious and this contract is a legal document under jurisdiction of European and American courts.
